These Terms of Service (“Terms” or “Agreement”) govern your access to and use of the Woof-Fit website, applications, content, courses, and related products and services, collectively, the “Services.” This Agreement is a legally binding contract between you (“you” or “your”) and Woof-Fit LLC (“Woof-Fit,” “we,” “us,” or “our”).

By accessing or using the Services, including by clicking “Continue,” “Sign up,” or “Purchase,” you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy. If you do not agree, you may not access or use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into this Agreement. If you accept these Terms on behalf of another person or entity, you represent that you are authorized to do so.

2. Accounts and Membership

Account Creation

To access certain features, you must create an account and provide accurate, current, and complete information, keeping it updated as needed.

Account Security

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at [email protected] if you become aware of any unauthorized access. Sharing your credentials with others is prohibited and may result in termination.

3. Health, Safety, and Assumption of Risk

Important: please read this section carefully before beginning any Woof-Fit activity.

Woof-Fit provides educational fitness and movement content for you and your dog to perform together. Physical exercise carries inherent risks of injury to people and to animals. The Services are for informational and educational purposes only and do not constitute medical advice, veterinary advice, or professional dog-training or behavioral advice, and are not a substitute for professional care.

For you, the human

• Consult a physician before beginning any exercise program, particularly if you are pregnant, recovering from injury or surgery, or have any cardiovascular, musculoskeletal, or other medical condition that could be affected by exercise.
• You participate voluntarily and at your own risk, exercise within your own physical limits, and assume all risk of injury to yourself.
• Stop immediately and seek medical advice if you experience pain, dizziness, shortness of breath, or any adverse reaction.

For your dog

• Obtain veterinary clearance before beginning any canine exercise program. All content assumes a healthy dog that has been cleared for physical activity.
• You are responsible for selecting movements appropriate to your dog’s age, breed, size, fitness level, and health, and for following any modifications provided. Puppies, senior dogs, and dogs with health conditions may require special care or veterinary guidance.
• Monitor your dog throughout, and stop immediately if your dog shows signs of pain, fatigue, lameness, distress, or reluctance. Seek veterinary advice if any adverse reaction occurs.
• You are solely responsible for your dog’s safety, handling, and behavior at all times, and for the safety of others and property around you during activity.

No guaranteed results

Individual results vary and are not guaranteed for you or your dog. Woof-Fit complements, and does not replace, professional medical, veterinary, or dog-training care, and we make no claim that the Services will treat, cure, or prevent any condition. By using the Services, you assume all risk of injury, loss, or damage to yourself, your dog, or any third party arising from your use of the Services.

4. Intellectual Property

All content within the Services, including videos, images, text, graphics, logos, exercises, routines, methodologies, course materials, and trademarks, is owned by Woof-Fit or its licensors and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only. Without our express written permission, you may not: copy, reproduce, distribute, or republish content; share or disclose your login credentials; record, screenshot, or download content except for personal reference; use any content for commercial purposes including teaching or reselling; create derivative works from our content or methodology; remove proprietary notices; or use automated tools to scrape or download content.

Monetizing our content without written consent may result in legal action and/or termination, and, to the fullest extent permitted by law, associated legal fees will be the responsibility of the offending party.

5. Prohibited Uses

You agree not to use the Services to: violate any law or regulation; infringe others’ intellectual property; share account credentials; interfere with or disrupt the Services; upload malware or harmful code; harass, abuse, or threaten others; impersonate any person or entity; pursue unauthorized commercial purposes; attempt unauthorized access; or harvest others’ personal information.

6. Third-Party Services

The Services rely on third-party providers, including Kajabi for platform hosting and Stripe, PayPal, and Kajabi Payments for payment processing. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

7. Billing, Payments, and Refunds

Payment Processing

All payments are processed securely through our third-party payment processors. By making a purchase, you agree to the applicable processor’s terms, and all fees are due according to the pricing in effect at the time of purchase.

The Program: Lifetime Access

Woof-Fit program is available for a one-time payment that grants lifetime access to the program content.

Refund Policy

We offer a 10-day money-back guarantee. If the program is not right for you and your dog, contact us at [email protected] within 10 days of purchase for a full refund.

Price Changes

We may modify pricing at any time; changes do not affect existing paid purchases until renewal.

8. EU / UK Consumer Rights and Right of Withdrawal

If you are a consumer in the European Union or United Kingdom, you ordinarily have a statutory 14-day right to withdraw from a distance purchase.

Digital content waiver. For digital content with immediate access: by purchasing and expressly requesting immediate access, and by acknowledging at checkout that you lose your right of withdrawal once access begins, you consent to begin receiving the Services immediately and waive your 14-day right of withdrawal. This waiver applies only after you have given that express consent and acknowledgment. We will confirm this consent in your purchase confirmation.

Nothing in these Terms affects statutory consumer rights that cannot be waived, including the right to receive Services that conform to their description and are fit for purpose.

9. Termination

You may stop using the Services at any time, and may close your account by contacting [email protected]. Termination does not entitle you to a refund except as required by your purchase terms or applicable law. We may suspend or terminate your access, with or without notice, if you violate these Terms, share credentials, behave abusively, initiate a bad-faith chargeback, engage in fraud, or use the Services unlawfully or unsafely.

Provisions that by their nature should survive termination will remain in effect.

10. Disclaimer of Warranties: “As Is”

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will meet your requirements, be uninterrupted or error-free, or produce any particular result for you or your dog. Any content obtained through the Services is used at your own discretion and risk.

Nothing here limits warranties that cannot be excluded under applicable law, including consumer protection laws.

11. Limitation of Liability

We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud or intentional misconduct.

To the maximum extent permitted by law, Woof-Fit and its officers, directors, agents, partners, and employees, the “Woof-Fit Parties,” will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of use, data, profits, or goodwill, under any legal theory, even if advised of the possibility. Except for liability that cannot be limited by law, the Woof-Fit Parties’ total liability for any claim arising out of or relating to these Terms or the Services is limited to the greater of $99 USD or the amount you paid to use the Services in the 12 months preceding the claim.

12. Indemnification

To the fullest extent permitted by law, you will indemnify, defend, and hold harmless the Woof-Fit Parties from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: your use of the Services; your User Content; your violation of these Terms or of any third-party right; or any injury or harm to you, your dog, or a third party resulting from your use of the exercises or content.

We may assume control of the defense or settlement of any such claim at our option, and you agree to cooperate.

13. Governing Law and Dispute Resolution

Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Mandatory consumer-protection laws of your country of residence may also apply.

14. Changes to These Terms

We may update these Terms from time to time. Changes are effective upon posting with a new “Last updated” date, and for material changes we will take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.
